Survivor that is how badly malnourished

this little boy was he was immediately
00:00:43
taken in to get him back on the right
00:00:45
track but he was in absolutely dire
00:00:48
condition on November 6th an Indiana
00:00:51
Department of Child Services case
00:00:52
manager was called out to the hospital
00:00:54
reporting indicates again that this baby
00:00:56
was suffering from Mal malnutrition
00:00:58
starvation DEH hydration you come to
00:01:01
find out that baby actually weighed Less
00:01:05
on that day than he did on the day that
00:01:06
he was born by 2 ounces when he was born
00:01:09
in August he weighed 6 lb 8 oz when he
00:01:11
showed up at the hospital on November
00:01:13
6th he weighed 6 lb 6 o I want to read
00:01:16
you what it says from the probable cause
00:01:19
affidavit in this case because it kind
00:01:21
of gives you a unfortunately better
00:01:23
perspective of what we're talking about
00:01:24
here so it says the victim was taken by
00:01:27
his mother Kristen Don for a regular
00:01:29
check up on September 11th 2024 and was
00:01:32
found to be underweight a follow-up
00:01:34
appointment was scheduled for 4 weeks
00:01:36
later but was cancelled by by Don and no
00:01:39
attempt was made by Don to reschedule
00:01:41
the appointment now the case worker
00:01:43
reported that while he was at the
00:01:45
hospital he could actually see the baby
00:01:49
skin hanging off of his arms loose skin
00:01:52
on his legs and his torso too he also
00:01:55
found out that it wasn't donay who
00:01:57
brought the baby to the hospital
00:01:58
remember I said that Good Samaritan it
00:02:00
was apparently a friend of Don's who'd
00:02:02
been worried about this child and when
00:02:05
Dona gets a call that her baby was being
00:02:07
admitted she finally arrives hours later
00:02:10
this is according to the affidavit and
00:02:12
Dona seemed to have a hard time
00:02:14
confirming for the medical staff exactly
00:02:16
how much she was feeding her baby and
00:02:19
how often At first she said that she was
00:02:21
feeding him 1 ounce of formula six times
00:02:23
a day but then later changed her story
00:02:26
to say that she was feeding the victim a
00:02:28
higher amount going back to that
00:02:30
affidavit when the case manager spoke
00:02:32
with the attending physician the doctor
00:02:34
quote confirmed that the baby boy was
00:02:36
diagnosed with dehydration and emaciated
00:02:39
temporal waste in the eyes and cheeks
00:02:41
resulting from malnutrition an example
00:02:43
provided in the report of emaciated
00:02:45
temporal waste is the sunken cheeks and
00:02:48
eyes of Holocaust victims suffering from
00:02:50
starvation and malnutrition and while
00:02:53
they were staying in the hospital the
00:02:55
medical staff reportedly discovered that
00:02:56
donay wasn't even feeding her baby over
00:02:59
overnight the staff would have to handle
00:03:01
those feedings according to the
00:03:03
affidavit after testing an observation
00:03:06
by medical staff it was determined that
00:03:07
the victim didn't suffer from any
00:03:09
medical conditions that would have
00:03:11
caused the weight loss so that will not
00:03:13
help her defense we'll talk about that
00:03:16
in a minute but this baby was removed
00:03:18
from dona's custody when he was
00:03:19
discharged from the hospital by the way
00:03:21
he'd already started to gain weight more
00:03:23
than a pound than just a few days he was
00:03:24
placed with a foster family and by the
00:03:26
time he got his next checkup he gained a
00:03:28
whopping 3 lb
00:03:30
just from proper care and nutrition is
00:03:32
it that hard now just to get some
00:03:34
perspective on this for you according to
00:03:37
doctors at that hospital if the friend
00:03:41
hadn't intervened when she did and
00:03:43
brought this baby to the hospital he
00:03:45
would have died he would have died of
00:03:46
starvation that's what they have
00:03:48
suggested now the deputy who wrote up
00:03:50
this probable cause affidavit says that
00:03:51
he sat down with Dona to get some more
00:03:53
information and the affidavit states
00:03:55
that Dona said that she gave birth to
00:03:57
the victim in August in Indianapolis
00:03:58
then moved to Evans to stay with the
00:04:00
friend who brought the baby to the
00:04:02
hospital so the friend seems to be kind
00:04:03
of like a roommate and in the affidavit
00:04:05
the baby is referred to as V1 or victim
00:04:08
one and she told the deputy that there
00:04:10
hadn't been any complications with his
00:04:12
birth and he had no medical problems up
00:04:14
till now it reads Kristen advised victim
00:04:17
one had experienced difficulty with
00:04:20
digesting formula when fed and would
00:04:22
spit up the majority of what he ingested
00:04:23
shortly after eating Kristen advised she
00:04:26
was aware the V1 was not eating properly
00:04:28
and as a result not being provided the
00:04:30
essential nutrients that an infant of
00:04:32
his age would require donate told the
00:04:34
deputy that while she was feeding the
00:04:36
baby 1 oz of formula six times a day she
00:04:38
doesn't know how much he was actually
00:04:40
able to keep down without spitting it up
00:04:43
and she said that she just waited to
00:04:44
take him to a scheduled visit but then
00:04:46
you know didn't take him to his
00:04:48
follow-up appointment even after she
00:04:49
noticed he was losing weight she also
00:04:51
admitted she never took him to the
00:04:52
emergency room despite the fact that he
00:04:54
was obviously getting worse and this
00:04:57
next part of the affidavit for me at
00:04:59
least is just honestly infuriating it
00:05:02
reads Kristen advised her friend was the
00:05:04
person who decided to take V V1 to the
00:05:06
hospital for treatment on November 6
00:05:08
2024 while she remained home to rest
00:05:11
after working her shift at Dollar
00:05:13
General Store Kristen advised she
00:05:15
generally worked 15 to 20 hours per week
00:05:17
at Dollar General Store Kristen advised
00:05:20
she had numerous things going on in her
00:05:21
life and work as reasons for not taking
00:05:23
V1 to the hospital after noticing that
00:05:25
he was losing weight and not thriving
00:05:28
isn't that just
00:05:30
great so look it is no secret I don't
00:05:33
like talking about these kinds of cases
00:05:36
they actually make me angry when I see
00:05:37
cases about children but I will tell you
00:05:41
it is important to cover especially in
00:05:43
bringing awareness to what might be
00:05:44
happening out there you see something
00:05:46
like this I mean here you have a
00:05:47
roommate apparently realizing something
00:05:49
was wrong and stepping in so it is our
00:05:52

really make anything better and Dona was

arrested on two charges of neglect of

dependent resulting in serious bodily
00:07:01
injury it's our understanding these are
00:07:02
third degree felonies a bond of $225,000
00:07:06
cash or $250,000 shity was set by a
00:07:09
judge in this case and so far it appears
00:07:10
Don has not made bail if she does she is
00:07:13
not allowed to have any contact at all
00:07:16
with her baby and attorneys are next
00:07:18
scheduled to appear in court in December
00:07:21

this case I think I laid out everything
00:07:36
that we know so far you did and thanks
00:07:39
for having me on Jesse this is really
00:07:42
disturbing right as as mothers as
00:07:44
parents we have one job it's to keep our
00:07:47
children safe to make sure they get
00:07:50
proper Medical Care and in this day and
00:07:53
age it's not that difficult given that
00:07:56
the
00:07:57
hospital um these days gives a lot of
00:08:00
Education to parents um while they're
00:08:02
there after giving birth and here this
00:08:05
woman despite uh having just given birth
00:08:08
despite knowing that there was something
00:08:10
wrong with her child that you know the
00:08:12
child is not eating the child's losing
00:08:15
weight when it should be G gaining
00:08:17
weight I mean those are all really
00:08:19
alarming signs and the fact that she
00:08:21
just sat back clearly decided that she
00:08:24
had other priorities in her life that
00:08:26
were more important and that this was
00:08:27
not one of them is really disturbing and
00:08:30
the prosecutors in this case and the
00:08:32
police did the right thing and what a
00:08:34
hero that friend that roommate is
00:08:36
because as I said if she didn't do this
00:08:39
there is a strong chance that baby would
00:08:40
have died and I I'm don't know if you've
00:08:43
seen cases like this before where it
00:08:44
just takes a Good Samaritan someone to
00:08:47
step up see something's wrong to Save a
00:08:50
Life absolutely and you know this
00:08:52
happens a lot with with the either young
00:08:55
dependent people such as children
00:08:57
infants or even El elderly people who
00:09:00
are sitting in their own filth and who
00:09:03
just need somebody to speak for them and
00:09:06
to come out and get the help that they
00:09:07
need and you know we as people in the
00:09:10
community that's our job that's our
00:09:13
responsibility to speak up and advocate
00:09:15
for people who are not able to do so
00:09:18
themselves and I'll tell you something
00:09:19
else Jesse I have two small children and
00:09:22
having just gone through this process I
00:09:24
have a two-year-old and a 5-year-old I
00:09:27
can tell you I mean I remember one gets
00:09:30
a stuffy nose or one gets a a
00:09:32
temperature that's a little higher than
00:09:34
they should I was the first person to
00:09:36
call it either take them to the doctor
00:09:38
take them to the hospital probably far
00:09:40
more so than I even needed to but just
00:09:43
that instinct as a mom to say oh my gosh
00:09:46
I have to do anything and everything I'd
00:09:48
rather air on the side of caution than
00:09:50
take a chance it really this case just
00:09:54
strikes a court because it it makes
00:09:56
absolutely no sense I can't imagine
00:09:58
looking at your child your helpless
00:10:00
little infant and not getting knowing
00:10:04
that there was a problem and not doing
00:10:05
something to help them by the way not to
00:10:08
take away from the serious seriousness
00:10:10
of this but as you were saying that I
00:10:12
think I heard your baby in the
00:10:13
background I think I heard your child
00:10:15
background so I mean the the timing of
00:10:18
that was pretty interesting but no I I I
00:10:20
just want to ask you about this because
00:10:22
in terms of Prosecuting a case like this
00:10:25
I have to feel this is one of and when I
00:10:27
say easier I'm not talking about the
00:10:29
subject matter the subject matter is
00:10:31
incredibly difficult for anyone to
00:10:33
process and especially for a jury to
00:10:35
hear and to see these kinds of photos
00:10:37
and for prosecutor to prosecute as well
00:10:39
but in terms of the difficulty of
00:10:41
actually securing a conviction here I
00:10:44
have to imagine it is relatively more
00:10:47
straightforward than other cases you
00:10:49
know look she's innocent until proven
00:10:51
guilty but it's kind of hard to say that
00:10:52
when you have a victim who is so young
00:10:56
and so helpless this is not a case uh of
00:11:00
self-defense this is not a case of an
00:11:01
adult victim where there's some sort of
00:11:03
other explanation I feel the amount of
00:11:06
defenses are limited here so would you
00:11:08
say that Prosecuting a case like this
00:11:10
would be relatively
00:11:12
straightforward they are very
00:11:14
straightforward absolutely and I'll tell
00:11:16
you that the the common defense if you
00:11:19
will I'm using that that term loosely
00:11:21
here that you see in a lot of these
00:11:23
cases is that the person did not have
00:11:25
the um cognitive ability or the
00:11:28
intellectual ual capability to know that
00:11:32
this their their child or their their
00:11:34
elderly parent or whatever the case may
00:11:36
be um needed this additional help or
00:11:39
support and so one of the things that is
00:11:41
going to be really important in this
00:11:42
case is that September 11 doctor's
00:11:45
appointment I would be very curious um
00:11:48
about what those doctors what advice
00:11:51
they gave because they are going to be
00:11:52
critical Witnesses here I knowing that
00:11:54
they gave a follow-up appointment I am
00:11:57
sure that they gave her steps and things
00:11:59
that she needed to do call if if the
00:12:02
child's not gaining weight try XYZ and
00:12:04
if that doesn't work call back and the
00:12:07
fact that she did not follow through
00:12:09
with doctor's instructions the fact that
00:12:11
she didn't take any of those steps and
00:12:13
to the contrary actually canel the
00:12:15
appointment um is really going to be
00:12:17
telling and probably very important in
00:12:20
this case so you are right I mean
00:12:22
obviously the child can't talk but I
00:12:24
think as you noted earlier something
00:12:27
else that's just very telling is the
00:12:29
roommate takes one look at the child and
00:12:31
says oh my gosh we've got to get this
00:12:33
baby Medical Care how did Mom not
00:12:36
recognize that for two months I mean to
00:12:38
to me that's astonishing well there are
00:12:40
these allegations that she was
00:12:41
recognizing her baby was in trouble and
00:12:44
the condition was getting worse that
00:12:46
knowledge component that again I think
00:12:49
if we talk about what potential defenses
00:12:51
there could be here whether it's a
00:12:53
mental health defense on her part it
00:12:55
seems though she recognized what was
00:12:57
going on so talked to me about would
00:13:00
there be a sort of mental health defense
00:13:02
and and also let me ask you what other
00:13:05
defenses could there be because again
00:13:07
taking these allegations as true she
00:13:10
knew what was
00:13:11
happening yes and based on what little
00:13:14
we know so far I don't see there being
00:13:16
any type of insanity defense I mean I
00:13:18
don't think we're there she doesn't
00:13:19
appear to be remotely close to that so I
00:13:22
mean the uh in terms of a a defense or
00:13:28
these types of what alcohol mitigation
00:13:30
factors many times defendants raise
00:13:32
those solely for the purpose of trying
00:13:35
to get a lesser sentence is look I I did
00:13:38
this I didn't mean to do this I I
00:13:40
probably should have done better but I'm
00:13:42
just you know with the limited knowledge
00:13:45
I have that's the best I could do and
00:13:47
that may not get them out of trouble but
00:13:50
I think that many times they're hoping
00:13:51
that a judge will take that into
00:13:53
consideration and say look you know
00:13:55
hopefully they won't do it again they
00:13:57
need education counseling probation and
00:14:00
and just you know maybe hoping that the
00:14:02
judge won't throw the book at him but in
00:14:04
this case I mean she's she's done enough
00:14:07
to know uh to to show her knowledge
00:14:11
about that there was in fact a problem
00:14:13
here and I think that's going to be very
00:14:15
difficult for her to get around um if if
00:14:17
the case does in fact go to a jury
00:14:19
that's what I was going to ask you do
00:14:20
you think there's an incentive for the
00:14:22
prosecution to try to have her plead
00:14:25
guilty to this and because a do you
00:14:28
really want want this to go to trial do
00:14:30
you want to subject a jury to all of
00:14:32
this information these kind of photos do
00:14:34
you want to have to prosecute a case
00:14:36
like this do you think a uh uh there
00:14:39
what would what would that look like
00:14:40
about offering you know offering some
00:14:42
sort of plea or or suggesting that she
00:14:44
take a plea what would that look like
00:14:46
and is there an advantage you think
00:14:47
there's an incentive I should say for
00:14:49
prosecutors to try to make sure this
00:14:51
doesn't go to trial well so a plea would
00:14:53
really depend largely on her her prior
00:14:55
criminal record I have seen neglect
00:14:58
cases that get probation um it's a third
00:15:00
deegree felony so generally
00:15:03
speaking a third deegree felony is
00:15:05
punishable by up to five years in prison
00:15:08
so the uh it's it it really depends if
00:15:12
she has no criminal record I cannot
00:15:14
imagine this being a circumstance where
00:15:15
there's any type of pre-trial diversion
00:15:18
program where she would get out of the
00:15:20
charges um but our Prosecutor's going to
00:15:23
throw the book at her and and and
00:15:25
sentence her to a long prison sentence
00:15:27
probably not
00:15:29
um and I say that only because they this
00:15:34
child does not from what we know appear
00:15:36
to have a father figure in his life and
00:15:38
so I I can imagine that that is going to
00:15:41
unless the kid is going to be signed
00:15:42
over and and adopted by a relative or a
00:15:45
loving Foster family of some sort you
00:15:48
know the child's welfare needs to be
00:15:50
taken into consideration as well and I'm
00:15:53
sure the prosecutors will be doing that
00:15:55
so hopefully there is a a family friend
00:15:58
or somebody responsible who can come in
00:16:00
and take proper care of the child moving
00:16:03
forward but to your question about an
00:16:05
incentive to to um get a lock in a
00:16:09
conviction I mean there's always an
00:16:11
incentive to do that right because
00:16:12
jurors no matter what the case is and no
00:16:15
matter how clear the evidence may be you
00:16:17
never know what a jury's going to do
00:16:19
there there could there could be a hung
00:16:20
jury you just never know so in order to
00:16:24
lock in a conviction hopefully get Mom
00:16:27
too under some type of of a uh Court
00:16:30
supervision long-term supervision where
00:16:33
she's required to let's say bring the
00:16:34
baby in for checkups go see a probation
00:16:37
officer get either mental health
00:16:39
counseling or maybe even parent
00:16:41
parenting classes um the court can have
00:16:44
that H Hammer hanging over her head if
00:16:46
they have her on some type of long-term
00:16:49
uh supervision like a probation or an
00:16:51
ankle monitor but um that's probably
00:16:54
what this looks like will she ever see
00:16:57
her son again
00:16:59
you know that that'll be up to to a
00:17:02
judge so what generally happens in these
00:17:05
cases is of course if she's in custody
00:17:07
she's not going to be taking care of her
00:17:08
kid but ultimately this case will
00:17:11
depending on what happens with this with
00:17:13
the criminal case it'll it'll work its
00:17:15
way through the family court system and
00:17:17
ultimately a judge is going to have to
00:17:19
determine whether she is a fit mother
00:17:22
they'll have to have her evaluated um
00:17:25
and and ultimately make that
00:17:26
determination but that is also a long
00:17:29
process that's not something that
00:17:31
happens immediately and she regardless
00:17:34
she may have supervised visits or things
00:17:36
of that nature until a determination is
00:17:38
made kind of hard to Fathom that she
00:17:41
would ever be in her child's life again
00:17:43
considering what these allegations are
00:17:44
it's hard for me again to say
00:17:46
allegations they are allegations but my
00:17:49
gosh the the evidence so far against her
00:17:51
is just so strong and equally disturbing
00:17:55

    • click on the arrow on the "Play" button and select "Convert" in the list;
    • select "Video - H.264 + MP3 (MP4)" in the "Profile" line;
    • click the "Browse" button to select a folder to save the converted video and click the "Start" button;
    • conversion speed depends on the resolution and duration of the video.

    Warning: this download method no longer works with most YouTube videos.
