That's according to a report in the New

York Times which found internal guidance

issued this week to US Citizenship and

Immigration Services field offices asked
00:00:23
that they supply office of immigration
00:00:26
litigation
00:00:28
with 100 to 200 dnaturalization
00:00:32
cases per month in the next fiscal year.
00:00:37
The Times reports it would represent a
00:00:39
massive escalation of dennaturalization
00:00:43
in the modern era. The news comes less
00:00:46
than two weeks after the Supreme Court
00:00:48
agreed to hear a case to decide the
00:00:50
constitutionality of President Trump's
00:00:52
executive order aiming to end birthright
00:00:56
citizenship.
00:00:58
to talk about all of this as well as the
00:01:01
latest threat by the Trump
00:01:02
administration that was uh issued last
00:01:05
night to end the visa diversity program
00:01:08
which leads to a green card for so many.
00:01:12
Uh we're joined now by May Nye,
00:01:14
professor of Asian-American studies and
00:01:15
history at Columbia University. Much of
00:01:17
her work focuses on immigration,
00:01:19
citizenship, and nationalism. Welcome

It's great to have you with us.

Let's start off.

>> Thanks for having me, Amy. Great to be

>> Explain for people who don't quite
00:01:33
understand, what is it to be a
00:01:35
naturalized citizen? And then what does
00:01:38
it mean that the Trump administration
00:01:42
wants to revoke that citizenship from
00:01:45
one to 200 people a month?
00:01:52
The United States has uh two kinds of
00:01:55
citizens. Those who are born in this
00:01:57
country who are automatically citizens
00:01:59
by birth. That's what we call birthright
00:02:01
citizenship. And naturalized citizens,
00:02:04
those people who are immigrants who can
00:02:06
apply to become a citizen after they've
00:02:08
been here for five years, take a test on
00:02:11
civics, um have no criminal record, etc.
00:02:16
The constitution treats both kinds of
00:02:18
citizens equally. Birthright citizens
00:02:21
and naturalized citizens are treated the
00:02:23
same under the 14th amendment of the
00:02:25
constitution. And we have naturalized uh
00:02:29
close to 10 million people in the last
00:02:32
10 years. Uh so there's a large number
00:02:34
of foreignb born Americans who are
00:02:38
citizens of this country.
00:02:40
>> Now to give you some context, what does
00:02:42
it mean? >> The mayor elect of New York, right? So
00:02:44
our M Dani is a naturalized citizen. He
00:02:47
was born in Uganda.
00:02:51
>> That's right. And Trump has explicitly
00:02:53
threatened to strip Mandami of his
00:02:56
citizenship.
00:02:58
>> So keep going with your explanation now.
00:03:02
>> Okay. So to give you some context, what
00:03:04
does it mean to say they want 100 to 200
00:03:07
cases per month? During the first Trump
00:03:10
administration,
00:03:12
they had 25 cases per year.
00:03:16
And before that, for the 15 years before
00:03:19
the first Trump administration, they had
00:03:22
fewer than uh 15 cases per year. So,
00:03:25
this is an incredible escalation. Um, I
00:03:29
want to say that it's doubtful that they
00:03:31
can actually do this, that they can
00:03:33
bring that many cases or that they can
00:03:36
successfully prosecute that many cases.
00:03:39
But it's like the mass deportation
00:03:41
program. You know, they have no
00:03:43
[clears throat] way to reach their goal
00:03:44
of 3,000 ICE arrests per month. But they
00:03:48
have spread terror and fear throughout
00:03:52
immigrant communities. And now that is
00:03:54
going to spread to um our fellow
00:03:56
citizens who are naturalized.
00:03:59
>> So how does this happen? How does it
00:04:02
start? Um if uh I were a naturalized
00:04:05
citizen, I get a um a notice that I am
00:04:10
going to lose my citizenship.
00:04:14
>> No, they can't do that. um DHS or
00:04:17
citizen uh immigration services cannot
00:04:21
unilaterally revoke your citizenship.
00:04:24
They have to go to a US attorney.
00:04:29
Uh and they the US attorney's office has
00:04:32
to file a law a suit a civil suit in
00:04:35
federal court and it has to go before a
00:04:37
judge. So it's a long process. Every
00:04:40
individual case has to be tried. And let
00:04:43
me say, Amy, the grounds to denaturalize
00:04:47
a citizen are very, very narrow. Very
00:04:50
narrow indeed. You have to show that the
00:04:54
citizen lied on their application in a
00:04:57
way that was meaningful to the outcome.
00:05:00
So, for example, we mostly know about
00:05:02
people who are war criminals who hid
00:05:04
their past. People who were members of
00:05:06
the Nazi party during World War II.
00:05:09
Those are the most famous cases. So, you
00:05:11
have to have misrepresented yourself uh
00:05:14
and hidden or committed fraud on your
00:05:17
application about something that would
00:05:18
have been consequential.
00:05:20
Now, in June, the Trump administration
00:05:23
expanded the list of uh reasons why they
00:05:27
could revoke somebody's naturalization.
00:05:31
These include um association with gangs
00:05:35
or cortels,
00:05:37
people who have uh been involved in
00:05:38
human trafficking, people who have
00:05:41
committed financial fraud against the
00:05:43
government or private individuals or
00:05:45
entities. That's an interesting one. Um
00:05:48
and so they have expanded the grounds
00:05:50
considerably.
00:05:51
And speaking of Mandani, I think one of
00:05:54
the things we have to be uh very
00:05:56
concerned about is their use of uh
00:06:00
political difference with the Trump
00:06:02
administration. I can imagine that they
00:06:05
will selectively
00:06:06
try to prosecute American citizens who
00:06:10
are naturalized who have spoken out
00:06:12
against Israel's genocide in Gaza. uh
00:06:16
you know Mandani has been accused of
00:06:19
being you know a Hamas supporter which
00:06:21
is not true but he does support
00:06:24
Palestine. Uh so this is kind going to
00:06:28
be I think a new ground upon which we
00:06:31
see the struggle for political speech.
00:06:36
You say that both birthright citizenship
00:06:40
and naturalized citizenship are
00:06:43
protected by the 14th amendment. So go
00:06:45
now to birthright citizenship and what's
00:06:47
going before the Supreme Court.
00:06:52
>> On day one of uh Trump taking office, he
00:06:56
declared he was going to re uh deny
00:07:00
birthright citizenship to babies born to
00:07:03
uh undocumented migrants and temporary
00:07:06
immigrants, people like foreign students
00:07:08
or guest workers. Now this has been
00:07:12
challenged in the courts. It's been um
00:07:15
turned down by several circuit courts
00:07:18
and now it's before the Supreme Court.
00:07:19
The Supreme Court has agreed to hear it.
00:07:21
And this is something that has over a
00:07:23
hundred years of precedence uh in our
00:07:25
country. Uh and this would be a terrible
00:07:28
blow if Trump were to uh or if the
00:07:30
Supreme Court were to uphold Trump's
00:07:32
executive order.
00:07:33
>> And explain what birthright citizenship
00:07:36
is.
00:07:39
It simply means that any person born on
00:07:42
the soil of the United States uh say for
00:07:45
those who are born to foreign diplomats
00:07:47
or an invading army which we don't have
00:07:48
that circumstance but anybody born on US
00:07:51
soil is by that fact a citizen of the
00:07:54
United States and there are I think some
00:07:58
300,000 babies born every year uh to
00:08:02
people who are undocumented um or
00:08:04
temporary immigrants uh who have
00:08:07
citizenship ship.
00:08:11

>> My parents were immigrants, but I'm a
00:08:16
birthright cit
00:08:19
Well, I was born in in this country. I
00:08:21
was born in the Bronx. My parents were
00:08:23
immigrants. They had come from China.
00:08:25
And um they they later became
00:08:27
naturalized citizens, but the time I was
00:08:29
born, they were immigrants. And um I was
00:08:33
uh born here and so I'm a citizen. So,
00:08:36
let's go to President Trump speaking
00:08:39
from the White House in June about his
00:08:41
plans to end birthright citizenship.
00:08:45
>> We can now promptly file to proceed with
00:08:48
numerous policies that have been wrongly
00:08:50
enjoined on a nationwide basis. And some
00:08:53
of the cases we're talking about would
00:08:55
be uh ending birthright citizenship,
00:08:59
which now comes to the four. That was
00:09:01
meant for the babies of slaves. It
00:09:03
wasn't meant for people trying to scam
00:09:04
the system and come into the country on
00:09:07
a vacation. This was in fact it was the
00:09:10
same date, the exact same date, the end
00:09:12
of the Civil War. It was meant for the
00:09:13
babies of slaves and it's so clean and
00:09:15
so obvious. But this lets us go there
00:09:18
and finally win that case because
00:09:20
hundreds of thousands of people are
00:09:22
pouring into our country under
00:09:24
birthright citizenship and it wasn't
00:09:26
meant for that reason.
00:09:27
So talk about what is meant for uh
00:09:30
Professor Nye.
00:09:33
>> Well, it was originally meant uh for the
00:09:36
babies of the former slaves. That is
00:09:38
true. Um but it was upheld by the
00:09:41
Supreme Court in 1898 in a Chinese case
00:09:45
called Wank Mark. And the court said
00:09:47
that it applied to the children of
00:09:49
immigrants as well, including Chinese
00:09:51
immigrants, which the court had no great
00:09:54
love for. And at that time the court
00:09:56
said if we eliminate birthright
00:09:59
citizenship for the Chinese
00:10:02
the citizenship of all the children of
00:10:04
all the Europeans who've come here would
00:10:06
be in jeopardy. So the court knew that
00:10:08
this was a far-reaching uh provision of
00:10:11
the constitution and it upheld it and
00:10:13
it's been upheld you know ever since.
00:10:17
I wanted to go what happened just last
00:10:20
night. Um, the Trump administration has
00:10:23
suspended the diversity visa lottery
00:10:27
program in the wake of the mass shooting
00:10:30
at Brown University and the murder of
00:10:33
the MIT physics professor Nuno Loredo.
00:10:36
Uh the suspect uh which seems to be the
00:10:39
same person in both cases was found dead
00:10:42
in a New Hampshire uh storage facility
00:10:46
uh self-inflicted wound named Clauddio
00:10:48
Manuel NeAs Valente. He entered the
00:10:52
country on a student visa in 2000. Um he
00:10:56
went to Brown apparently as a physics
00:10:59
graduate student was in that building
00:11:01
where the young people were shot up uh
00:11:04
this past weekend. Um, so he got a visa,
00:11:08
a student visa in 2000 and then
00:11:11
apparently was granted a green card
00:11:13
through the visa diversity program in
00:11:16
2017.
00:11:18
Um, now the Trump administration is
00:11:20
saying based on this one person, they're
00:11:23
going to end this. What exactly is the
00:11:26
diversity visa program, what's called a
00:11:29
green card program, and what would it
00:11:30
mean?
00:11:34
First of all, I want to say that it's a
00:11:36
utter tragedy what happened at Brown and
00:11:38
MIT. Uh, and this is typical of the
00:11:41
Trump administration to weaponize
00:11:43
unfortunate instance instances like this
00:11:46
uh to pursue a different agenda. The
00:11:49
diversity
00:11:50
visa program was passed by Congress in
00:11:53
1990.
00:11:55
It allows for 50,000 green cards to be
00:11:58
given to people in a lottery system. Now
00:12:01
people may know that the regular system
00:12:05
you have to have a family member in this
00:12:07
country or a guarantee of employment
00:12:09
from an employer. So the diversity
00:12:12
option through the lottery is just for
00:12:14
anybody. Now they instituted that in
00:12:17
1990 in the hopes of bringing in more
00:12:20
white people,
00:12:22
Irish, you know, uh, Eastern Europeans,
00:12:25
etc. But what happened in the diversity
00:12:27
was that a lot of people who got the
00:12:29
lottery were from Africa or other
00:12:32
countries. So there have been calls in
00:12:34
Congress to get rid of it because it's
00:12:36
not what it was intended for, which was
00:12:38
to make the immigration stream more
00:12:41
white. And I think all of these things
00:12:44
are just indices of the Trump
00:12:46
administration's
00:12:48
bigger agenda, which is to make this
00:12:51
country a white Christian nation to
00:12:54
strip people of their citizenship.
00:12:56
They're going to go after certain kinds
00:12:57
of people. Obviously, we see in the mass
00:13:00
deportation system. We see in their end
00:13:03
to the amnesty programs and refugee
00:13:06
programs. And we see in this the attempt
00:13:09
to uh eliminate the diversity v which
00:13:13
actually has to be done by congress but
00:13:15
you know they they do all these things
00:13:17
because they don't like the color or the
00:13:20
politics of the people who come to this
00:13:22
country. Last quick question. A federal
00:13:25
judge this week uh ruled the Trump
00:13:27
administration broke the law by limiting
00:13:31
uh Congress members access to ICE jails.
00:13:34
Can you talk about the significance of
00:13:36
this? We have 20 seconds.

>> Well, the Trump administration acts with
00:13:43
no oversight whatsoever. Whether it's a
00:13:46
Supreme Court or Congress, he is acting
00:13:48
like a dictator, an authoritarian, and
00:13:51
it's just a terrible thing. And the
00:13:53
American people have to protest and
00:13:55
oppose these.
