issued this week to US Citizenship and00:00:20
Immigration Services field offices asked00:00:23
that they supply office of immigration00:00:26
litigation00:00:28
with 100 to 200 dnaturalization00:00:32
cases per month in the next fiscal year.00:00:37
The Times reports it would represent a00:00:39
massive escalation of dennaturalization00:00:43
in the modern era. The news comes less00:00:46
than two weeks after the Supreme Court00:00:48
agreed to hear a case to decide the00:00:50
constitutionality of President Trump's00:00:52
executive order aiming to end birthright00:00:56
citizenship.00:00:58
to talk about all of this as well as the00:01:01
latest threat by the Trump00:01:02
administration that was uh issued last00:01:05
night to end the visa diversity program00:01:08
which leads to a green card for so many.00:01:12
Uh we're joined now by May Nye,00:01:14
professor of Asian-American studies and00:01:15
history at Columbia University. Much of00:01:17
her work focuses on immigration,00:01:19
citizenship, and nationalism. Welcome00:01:22

Let's start off.00:01:27

>> Explain for people who don't quite00:01:33
understand, what is it to be a00:01:35
naturalized citizen? And then what does00:01:38
it mean that the Trump administration00:01:42
wants to revoke that citizenship from00:01:45
one to 200 people a month?00:01:52
The United States has uh two kinds of00:01:55
citizens. Those who are born in this00:01:57
country who are automatically citizens00:01:59
by birth. That's what we call birthright00:02:01
citizenship. And naturalized citizens,00:02:04
those people who are immigrants who can00:02:06
apply to become a citizen after they've00:02:08
been here for five years, take a test on00:02:11
civics, um have no criminal record, etc.00:02:16
The constitution treats both kinds of00:02:18
citizens equally. Birthright citizens00:02:21
and naturalized citizens are treated the00:02:23
same under the 14th amendment of the00:02:25
constitution. And we have naturalized uh00:02:29
close to 10 million people in the last00:02:32
10 years. Uh so there's a large number00:02:34
of foreignb born Americans who are00:02:38
citizens of this country.00:02:40
>> Now to give you some context, what does00:02:42
it mean? >> The mayor elect of New York, right? So00:02:44
our M Dani is a naturalized citizen. He00:02:47
was born in Uganda.00:02:51
>> That's right. And Trump has explicitly00:02:53
threatened to strip Mandami of his00:02:56
citizenship.00:02:58
>> So keep going with your explanation now.00:03:02
>> Okay. So to give you some context, what00:03:04
does it mean to say they want 100 to 20000:03:07
cases per month? During the first Trump00:03:10
administration,00:03:12
they had 25 cases per year.00:03:16
And before that, for the 15 years before00:03:19
the first Trump administration, they had00:03:22
fewer than uh 15 cases per year. So,00:03:25
this is an incredible escalation. Um, I00:03:29
want to say that it's doubtful that they00:03:31
can actually do this, that they can00:03:33
bring that many cases or that they can00:03:36
successfully prosecute that many cases.00:03:39
But it's like the mass deportation00:03:41
program. You know, they have no00:03:43
[clears throat] way to reach their goal00:03:44
of 3,000 ICE arrests per month. But they00:03:48
have spread terror and fear throughout00:03:52
immigrant communities. And now that is00:03:54
going to spread to um our fellow00:03:56
citizens who are naturalized.00:03:59
>> So how does this happen? How does it00:04:02
start? Um if uh I were a naturalized00:04:05
citizen, I get a um a notice that I am00:04:10
going to lose my citizenship.00:04:14
>> No, they can't do that. um DHS or00:04:17
citizen uh immigration services cannot00:04:21
unilaterally revoke your citizenship.00:04:24
They have to go to a US attorney.00:04:29
Uh and they the US attorney's office has00:04:32
to file a law a suit a civil suit in00:04:35
federal court and it has to go before a00:04:37
judge. So it's a long process. Every00:04:40
individual case has to be tried. And let00:04:43
me say, Amy, the grounds to denaturalize00:04:47
a citizen are very, very narrow. Very00:04:50
narrow indeed. You have to show that the00:04:54
citizen lied on their application in a00:04:57
way that was meaningful to the outcome.00:05:00
So, for example, we mostly know about00:05:02
people who are war criminals who hid00:05:04
their past. People who were members of00:05:06
the Nazi party during World War II.00:05:09
Those are the most famous cases. So, you00:05:11
have to have misrepresented yourself uh00:05:14
and hidden or committed fraud on your00:05:17
application about something that would00:05:18
have been consequential.00:05:20
Now, in June, the Trump administration00:05:23
expanded the list of uh reasons why they00:05:27
could revoke somebody's naturalization.00:05:31
These include um association with gangs00:05:35
or cortels,00:05:37
people who have uh been involved in00:05:38
human trafficking, people who have00:05:41
committed financial fraud against the00:05:43
government or private individuals or00:05:45
entities. That's an interesting one. Um00:05:48
and so they have expanded the grounds00:05:50
considerably.00:05:51
And speaking of Mandani, I think one of00:05:54
the things we have to be uh very00:05:56
concerned about is their use of uh00:06:00
political difference with the Trump00:06:02
administration. I can imagine that they00:06:05
will selectively00:06:06
try to prosecute American citizens who00:06:10
are naturalized who have spoken out00:06:12
against Israel's genocide in Gaza. uh00:06:16
you know Mandani has been accused of00:06:19
being you know a Hamas supporter which00:06:21
is not true but he does support00:06:24
Palestine. Uh so this is kind going to00:06:28
be I think a new ground upon which we00:06:31
see the struggle for political speech.00:06:36
You say that both birthright citizenship00:06:40
and naturalized citizenship are00:06:43
protected by the 14th amendment. So go00:06:45
now to birthright citizenship and what's00:06:47
going before the Supreme Court.00:06:52
>> On day one of uh Trump taking office, he00:06:56
declared he was going to re uh deny00:07:00
birthright citizenship to babies born to00:07:03
uh undocumented migrants and temporary00:07:06
immigrants, people like foreign students00:07:08
or guest workers. Now this has been00:07:12
challenged in the courts. It's been um00:07:15
turned down by several circuit courts00:07:18
and now it's before the Supreme Court.00:07:19
The Supreme Court has agreed to hear it.00:07:21
And this is something that has over a00:07:23
hundred years of precedence uh in our00:07:25
country. Uh and this would be a terrible00:07:28
blow if Trump were to uh or if the00:07:30
Supreme Court were to uphold Trump's00:07:32
executive order.00:07:33
>> And explain what birthright citizenship00:07:36
is.00:07:39
It simply means that any person born on00:07:42
the soil of the United States uh say for00:07:45
those who are born to foreign diplomats00:07:47
or an invading army which we don't have00:07:48
that circumstance but anybody born on US00:07:51
soil is by that fact a citizen of the00:07:54
United States and there are I think some00:07:58
300,000 babies born every year uh to00:08:02
people who are undocumented um or00:08:04
temporary immigrants uh who have00:08:07
citizenship ship.00:08:11
>> I wanted00:08:12

>> My parents were immigrants, but I'm a00:08:16
birthright cit00:08:19
Well, I was born in in this country. I00:08:21
was born in the Bronx. My parents were00:08:23
immigrants. They had come from China.00:08:25
And um they they later became00:08:27
naturalized citizens, but the time I was00:08:29
born, they were immigrants. And um I was00:08:33
uh born here and so I'm a citizen. So,00:08:36
let's go to President Trump speaking00:08:39
from the White House in June about his00:08:41
plans to end birthright citizenship.00:08:45
>> We can now promptly file to proceed with00:08:48
numerous policies that have been wrongly00:08:50
enjoined on a nationwide basis. And some00:08:53
of the cases we're talking about would00:08:55
be uh ending birthright citizenship,00:08:59
which now comes to the four. That was00:09:01
meant for the babies of slaves. It00:09:03
wasn't meant for people trying to scam00:09:04
the system and come into the country on00:09:07
a vacation. This was in fact it was the00:09:10
same date, the exact same date, the end00:09:12
of the Civil War. It was meant for the00:09:13
babies of slaves and it's so clean and00:09:15
so obvious. But this lets us go there00:09:18
and finally win that case because00:09:20
hundreds of thousands of people are00:09:22
pouring into our country under00:09:24
birthright citizenship and it wasn't00:09:26
meant for that reason.00:09:27
So talk about what is meant for uh00:09:30
Professor Nye.00:09:33
>> Well, it was originally meant uh for the00:09:36
babies of the former slaves. That is00:09:38
true. Um but it was upheld by the00:09:41
Supreme Court in 1898 in a Chinese case00:09:45
called Wank Mark. And the court said00:09:47
that it applied to the children of00:09:49
immigrants as well, including Chinese00:09:51
immigrants, which the court had no great00:09:54
love for. And at that time the court00:09:56
said if we eliminate birthright00:09:59
citizenship for the Chinese00:10:02
the citizenship of all the children of00:10:04
all the Europeans who've come here would00:10:06
be in jeopardy. So the court knew that00:10:08
this was a far-reaching uh provision of00:10:11
the constitution and it upheld it and00:10:13
it's been upheld you know ever since.00:10:17
I wanted to go what happened just last00:10:20
night. Um, the Trump administration has00:10:23
suspended the diversity visa lottery00:10:27
program in the wake of the mass shooting00:10:30
at Brown University and the murder of00:10:33
the MIT physics professor Nuno Loredo.00:10:36
Uh the suspect uh which seems to be the00:10:39
same person in both cases was found dead00:10:42
in a New Hampshire uh storage facility00:10:46
uh self-inflicted wound named Clauddio00:10:48
Manuel NeAs Valente. He entered the00:10:52
country on a student visa in 2000. Um he00:10:56
went to Brown apparently as a physics00:10:59
graduate student was in that building00:11:01
where the young people were shot up uh00:11:04
this past weekend. Um, so he got a visa,00:11:08
a student visa in 2000 and then00:11:11
apparently was granted a green card00:11:13
through the visa diversity program in00:11:16
2017.00:11:18
Um, now the Trump administration is00:11:20
saying based on this one person, they're00:11:23
going to end this. What exactly is the00:11:26
diversity visa program, what's called a00:11:29
green card program, and what would it00:11:30
mean?00:11:34
First of all, I want to say that it's a00:11:36
utter tragedy what happened at Brown and00:11:38
MIT. Uh, and this is typical of the00:11:41
Trump administration to weaponize00:11:43
unfortunate instance instances like this00:11:46
uh to pursue a different agenda. The00:11:49
diversity00:11:50
visa program was passed by Congress in00:11:53
1990.00:11:55
It allows for 50,000 green cards to be00:11:58
given to people in a lottery system. Now00:12:01
people may know that the regular system00:12:05
you have to have a family member in this00:12:07
country or a guarantee of employment00:12:09
from an employer. So the diversity00:12:12
option through the lottery is just for00:12:14
anybody. Now they instituted that in00:12:17
1990 in the hopes of bringing in more00:12:20
white people,00:12:22
Irish, you know, uh, Eastern Europeans,00:12:25
etc. But what happened in the diversity00:12:27
was that a lot of people who got the00:12:29
lottery were from Africa or other00:12:32
countries. So there have been calls in00:12:34
Congress to get rid of it because it's00:12:36
not what it was intended for, which was00:12:38
to make the immigration stream more00:12:41
white. And I think all of these things00:12:44
are just indices of the Trump00:12:46
administration's00:12:48
bigger agenda, which is to make this00:12:51
country a white Christian nation to00:12:54
strip people of their citizenship.00:12:56
They're going to go after certain kinds00:12:57
of people. Obviously, we see in the mass00:13:00
deportation system. We see in their end00:13:03
to the amnesty programs and refugee00:13:06
programs. And we see in this the attempt00:13:09
to uh eliminate the diversity v which00:13:13
actually has to be done by congress but00:13:15
you know they they do all these things00:13:17
because they don't like the color or the00:13:20
politics of the people who come to this00:13:22
country. Last quick question. A federal00:13:25
judge this week uh ruled the Trump00:13:27
administration broke the law by limiting00:13:31
uh Congress members access to ICE jails.00:13:34
Can you talk about the significance of00:13:36
this? We have 20 seconds.00:13:40
>> Well, the Trump administration acts with00:13:43
no oversight whatsoever. Whether it's a00:13:46
Supreme Court or Congress, he is acting00:13:48
like a dictator, an authoritarian, and00:13:51
it's just a terrible thing. And the00:13:53
American people have to protest and00:13:55
oppose these.00:13:56
