the United States Attorney for the

Eastern District of Virginia. And we

want to understand why after she was

disqualified by a prior judge, Judge

Curry in the Comey case, why is she
00:00:37
still showing up in our records and
00:00:39
representing that she's this United
00:00:41
States attorney? And this was directed
00:00:44
at an assistant United States attorney,
00:00:46
basically a line prosecutor, the
00:00:48
day-to-day prosecutors who are doing
00:00:50
their work uh for the Eastern District
00:00:52
of Virginia Federal Prosecutor's Office.

and they said, "We're being forced to do
00:00:56
it." Like, judge, we're being told by
00:00:59
the Department of Justice, Office of
00:01:01
Legal Counsel to keep her name on. She's
00:01:04
our boss, so we don't really have an
00:01:06
option or say in this. to which this
00:01:09
federal judge, Judge Brinkma, says,

"Well, don't you think that after all of
00:01:14
these rulings we've seen across the
00:01:16
country, whether it's the third circuit
00:01:17
court of appeal, saying Alina Haba needs
00:01:19
to go because she was disqualified,
00:01:21
you're just going to have a fake
00:01:23
pretending United States attorney for
00:01:25
the Eastern District of Virginia, who
00:01:27
should never have been there in the
00:01:28
first place? Don't you think that's
00:01:30
going to taint all of your other cases?"
00:01:32
Now, in response to this, we've been
00:01:34
seeing statements, official statements
00:01:35
from the Department of Justice that are
00:01:38
some of the weirdest things I've ever
00:01:39
read. Like this statement right here
00:01:41
from Attorney General Pam Bondi and the
00:01:43
Deputy Attorney General Todd Blanch.
00:01:46
Certain District Court and Magistrate
00:01:48
judges in the Eastern District of
00:01:49
Virginia are engaging in an
00:01:52
unconscionable campaign of bias and
00:01:55
hostility against United States Attorney
00:01:58
Lindseay Heligan and her line Aus. In
00:02:01
other words, the judges are picking on
00:02:03
us. The federal judges are going after
00:02:05
us. Lindsay and our attorneys are simply
00:02:07
doing their jobs, advocating for the
00:02:09
Department of Justice's position while
00:02:12
following guidance from the Office of
00:02:14
Legal Counsel. They do not deserve to
00:02:16
have their reputations questioned in
00:02:18
court for ethically advocating on behalf
00:02:20
of their client. This Department of
00:02:22
Justice has no tolerance for
00:02:24
undemocratic judicial activism. We will
00:02:27
continue fighting for public safety in
00:02:29
courtrooms across the country. And we
00:02:31
will not be deterred by rogue judges who
00:02:34
failed to live up to their obligations
00:02:36
of impartiality because of their own
00:02:38
political views. The American people and
00:02:41
the people of the Eastern District of
00:02:43
Virginia deserve nothing less. No, the
00:02:47
nothing less. The the less here is
00:02:50
Lindseay Halligan who was never a
00:02:52
federal prosecutor before, never even
00:02:55
interned for the office, has zero
00:02:57
experience, was put there purely for
00:02:59
Donald Trump to be able to prosecute
00:03:03
James Comey and New York Attorney
00:03:04
General Leticia James. They screwed that
00:03:07
up. She was there in a grand jury all by
00:03:09
herself and she like ended up having a
00:03:12
fake second indictment that the grand
00:03:14
jury didn't even review. They tried to
00:03:17
pass that off as the actual indictment
00:03:19
for Comey. We learned that she didn't
00:03:20
even know the legal instructions or
00:03:22
provided false legal instructions to the
00:03:24
grand jury. She put up a witness, this
00:03:27
FBI agent who was not allowed to testify
00:03:30
in the first place because he was
00:03:31
exposed to attorney client privilege.
00:03:33
And then we didn't even get to those
00:03:34
issues because Lindseay Halligan was
00:03:36
disqualified from the outset. This isn't
00:03:38
about partisan politics or anything
00:03:41
other than the United States
00:03:42
Constitution, which says that these
00:03:44
types of officers like the United States
00:03:47
attorneys from the various districts
00:03:49
need to be appointed by the president
00:03:51
and confirmed by the Senate. There's an
00:03:53
accompanying statute that was passed
00:03:56
that says, "Look, we get that sometimes
00:03:58
the Senate confirmation process can take
00:04:00
a little bit of time. So, we'll allow
00:04:03
the president to put someone in place of
00:04:06
a United States attorney on an interim
00:04:08
basis for 120 days, but you only get to
00:04:12
do that once. That 120day term can be
00:04:15
extended by a vote of the district court
00:04:18
judges who are comprised of judges
00:04:20
appointed from all political parties and
00:04:22
prior presidents. That term can be
00:04:24
extended, but if it's not extended, that
00:04:26
person needs to go as the United States
00:04:29
attorney. And you only get to do this
00:04:30
once. So in the Eastern District of
00:04:32
Virginia, for example, the Trump regime
00:04:34
picked a guy, Sebert, who was a
00:04:37
Republican, a Trump interim, and this
00:04:39
guy was going to get confirmed. The
00:04:40
Senate said they were ready to confirm
00:04:42
him, but Trump didn't want this guy
00:04:44
confirmed because the guy was not
00:04:45
willing to prosecute James Comey and New
00:04:48
York attorney general Leticia James
00:04:49
because he didn't see the evidence
00:04:50
there. He said it would be a frivolous
00:04:52
case. So he said, "I can't do that." So
00:04:54
Trump got his one shot, fired the guy or
00:04:57
pushed him out, forced him to resign,
00:04:59
then put in haligan. You can't do that.
00:05:01
Okay, that's not a Democratic or
00:05:03
Republican, an independent. That's just
00:05:04
what the law says. It's a basic law. You
00:05:07
go to New Jersey, Alina Haba stayed
00:05:10
there longer than 120 days and you only
00:05:13
get 120 days. Then the district court
00:05:16
judges didn't extend Alina Haba's term.
00:05:18
They fired her. So then they appointed
00:05:21
the first assistant district at um first
00:05:24
assistant United States attorney and
00:05:26
said, "Okay, well you're now the
00:05:27
interim. You're the new person." So
00:05:29
Alina Haba then fired that person and
00:05:32
then said, "Well, I took her job now.
00:05:33
So, I'm the interim because you
00:05:35
appointed a new interim judges and I
00:05:37
stole her job. They're like, "You can't
00:05:38
do that. You had the chance. We didn't
00:05:41
extend your term." And the third circuit
00:05:43
rejected her. And here the district
00:05:45
court judges in Virginia from all
00:05:47
political parties are furious. They're
00:05:49
like, "Get her out of here. She's a
00:05:51
squatter. What the hell is she doing in
00:05:53
here?" And this is in addition to the
00:05:56
reporting we were talking about last
00:05:58
week when I had Harry Litman from the
00:05:59
Talking Feds YouTube channel and Talking
00:06:01
Fed podcast talking about this. Let's
00:06:03
bring in Harry Litman because this is an
00:06:04
update to our reporting. Last week, the
00:06:07
judges were fed up. Now, they're just
00:06:08
outright furious because Lindseay
00:06:11
Hallan's name on these files, it's just
00:06:14
and I think the judges feel two things.
00:06:16
One, that the that their courts are
00:06:19
being so disrespected. Um, two of three
00:06:23
things. too that they're worried that
00:06:24
these other cases unrelated to the the
00:06:27
Comey and New York attorney general
00:06:29
District that these other cases are now
00:06:31
being tainted and these criminal
00:06:33
defendants have these avenues to appeal
00:06:36
and to do these and get these dismissals
00:06:39
and then I think they're a lot of these
00:06:41
judges have backgrounds with the DOJ or
00:06:43
working at the DOJ and they're seeing
00:06:45
the fall of this once proud institution
00:06:49
and it's just an embarrassing
00:06:50
humiliation stain. You worked at the
00:06:53
DOJ. That's why your show is called
00:06:55
Talking Feds. Feds, you're a federal
00:06:56
prosecutor. You were the top federal
00:06:58
prosecutor out of Pennsylvania's one of
00:07:01
the districts there. And you were a top
00:07:03
prosecutor out of Maine justice. So,

make this make sense, Harry. I can't

make it make sense, but I can hopefully

explain a little bit more why it doesn't

make sense. First, everything you say on

the law is right. And you know, it's
00:07:17
labyrinthine, but we've known that

before. There's a reason for it. And by

the way, this incredible contempt and uh
00:07:26
in disparagement from Pam Bondi, you
00:07:30
know, she just doesn't know the
00:07:32
Constitution because here Congress has
00:07:34
acted in addition to everything else
00:07:36
where you say, of course, they want to
00:07:39
protect their own ability and not have
00:07:41
the presidency do end runs around it. It
00:07:46
is right in the constitution that
00:07:48
Congress shall determine the process for
00:07:50
appointing inferior officers undisputed.
00:07:53
That's what a US attorney is. But you
00:07:56
think about this hapless a USA. It's
00:07:58
kind of back to the March 15th Abrao
00:08:02
Garcia times where they're just in there
00:08:05
doing their own thing. And um I think
00:08:08
your analysis, Ben, is spot. These first
00:08:10
two points are spoton. Remember, it does
00:08:13
fall to the court to decide who should
00:08:16
be the um US attorney. It's not a
00:08:19
political decision when when the interim
00:08:21
has run out until there's a
00:08:23
confirmation. And it's not a political
00:08:25
decision. They just want to put someone
00:08:27
competent in. and the um broadside from
00:08:32
Bondi saying the court and magistrates
00:08:35
there are insulting when when really
00:08:37
what they're saying is everything you
00:08:39
say everything Bondi says can just be
00:08:42
summarized as the laws against us. Uh
00:08:45
but she can only see view it through the
00:08:48
prism of some kind of political um
00:08:52
attack from the judges. So they resent
00:08:55
that for sure. but also they're the ones
00:08:57
who are going to at least in part have
00:08:59
to clean up the mess. We know that uh
00:09:03
when you're not um Haligan could as well
00:09:08
be, you know, I I've been struggling for
00:09:11
the best um uh metaphor here, but she
00:09:14
could be Mickey Mouse. She could be
00:09:17
Benjamin Franklin. She's a pretend
00:09:20
nonprosecutor
00:09:22
and she's not permitted a pretend
00:09:25
nonprosecutor who doesn't legitimately
00:09:27
have the power of the United States even
00:09:29
to supervise a case. So every single one
00:09:32
it's as if she's recused. She is in one
00:09:35
of I think the third circuit opinion
00:09:37
about Haba puts it a legal nullity. So
00:09:42
every case that is brought, every
00:09:44
indictment for every crime, and of
00:09:46
course they are simultaneously doing
00:09:49
their political prosecutions,
00:09:52
but also there's some pretty serious
00:09:54
crimes in the District of New Jersey,
00:09:56
the Eastern District of Virginia, and

those are the very ones that, you know,
00:10:02
would normally be done in the name of
00:10:04
public safety that they are
00:10:05
jeopardizing. You're going to have
00:10:07
defendants without the slightest doubt
00:10:11
come in front of the Eastern District of
00:10:13
Virginia and judges like Leone Brinkma
00:10:16
and say to her, you know, you cannot uh
00:10:19
this wasn't a legit indictment and it
00:10:22
was maybe different when Haligan
00:10:24
stumbled into it not knowing, but she
00:10:27
knew about it and uh and still went
00:10:30
forward. Let me say a little bit more

about this claim that OLC has blessed
00:10:35
it. They have not. What has happened is
00:10:39
the um political
00:10:42
um officials at DOJ like Todd Blanch
00:10:46
have just given a command from the White
00:10:48
House. You keep calling her US attorney.
00:10:51
We you know we know Haba has resigned
00:10:54
and Halagan has been disqualified. You
00:10:56
keep calling her US attorney. We are
00:10:59
told that at the same time the office of
00:11:02
legal counsel is looking into this. But
00:11:05
the claim that they're hoping OLC
00:11:07
blesses and you know who knows if the
00:11:10
OLC is the old OLC and does things with
00:11:13
integrity is well Judge Curry
00:11:17
disqualified her said she's a legal
00:11:19
nully but she didn't exactly say leave
00:11:22
office so therefore she can stay there.
00:11:26
Think about that for half a second. It's
00:11:28
so desperate. It's so contemptuous. And
00:11:31
it is such a freight train leading to
00:11:35
disaster. We have someone who is a legal
00:11:38
nully. The bottom of the uh opinion from
00:11:41
Judge Curry didn't say leave office. So
00:11:43
now she stays there and a legal nully
00:11:46
oversees the um indictments of serious
00:11:51
criminals. You just can't do it. It's a
00:11:53
violation of the Constitution. So, I
00:11:56
don't see even if OLC does some kind of
00:11:59
far-fetched opinion, well, you don't
00:12:01
have to uh so long as the direct command
00:12:06
hasn't been made that they could not
00:12:08
possibly opine that um that courts would
00:12:12
be uh out of their um authority in
00:12:16
saying as they got to there's a problem
00:12:19
with this indictment, that indictment,
00:12:20
every single friaking indictment that
00:12:23
now comes out of the EDVA, which I can
00:12:25
remind you or our listeners, Ben, you
00:12:28
know it very well, has these really big
00:12:32
defense and defense industry and really
00:12:36
big all kinds of cases. They're all
00:12:38
being totally threatened. Now, we saw,
00:12:41
it's interesting, there's a little bit
00:12:42
of a schizophrenia here. Even with uh
00:12:45
Churish um you know complaint about
00:12:48
activist judges, they saw the writing on
00:12:50
the wall and stood down as to Haba. The
00:12:53
exact same position unless the fourth
00:12:56
circuit over Curry gives some kind of
00:12:59
stay. The state of the law is the exact
00:13:02
thing. The risk they're taking is the
00:13:04
exact risk that caused them to see
00:13:07
reason in the Hobbit case and say,
00:13:09
"Okay, uh we're resigning here now
00:13:12
because it's going to be bad. You can't
00:13:13
run an office with a legal nullity as US
00:13:16
attorney. That's precisely who Lindseay
00:13:19
Halagan is. And as you point out, she's
00:13:22
even less qualified than Alina Haba.

Less experience, you know, more
00:13:27
problematic in every way. So, the
00:13:29
combination of contempt and really just
00:13:34
complete implausible
00:13:36
uh kind of reasoning. Well, she didn't
00:13:39
they didn't say to remove her, so keep
00:13:40
her in. They're they're they're going
00:13:42
right into a brick wall at um you know
00:13:45
100 miles an hour and doing it with
00:13:49
total contempt. But it's a it's a train
00:13:51
wreck. And again, the train wreck is not
00:13:53
just for the administration's political
00:13:56
efforts to want to reward a political
00:14:00
loyalist of Trump and indict a
00:14:03
antagonist of Trump. It's the bread and
00:14:06
butter cases that the US Attorney's
00:14:08
Office prosecutes every day in the
00:14:11
protection of public safety. All of
00:14:15
which they've jeopardized with a
00:14:17
complete unreasonable caprice that I do
00:14:20
not believe OLC could possibly bless.

like a baseball game, [clears throat]

you know, and uh you're watching there,

you're with your family, and there's a

streaker who runs through the field,

right? Who doesn't belong there? It's

going to be good how you're going to tie

have to do is just stay in the audience

and watch the game. Now, with Lindseay

Halligan, after the order by Judge Curry

disqualifying her and saying she's

unlawful to be in this position, all the

Department of Justice would literally

have to do is essentially nothing and
00:15:18
preserve the status quo before her,
00:15:20
which is you just don't put her name on
00:15:22
the pleadings and she doesn't show up to
00:15:24
the office where she doesn't belong. And
00:15:26
that's what existed before. the office
00:15:28
would now have a first assistant who
00:15:31
could run the office until that was
00:15:32
figured out. It could function properly
00:15:35
and they could handle the cases and
00:15:36
there wouldn't be issues. But they
00:15:38
insist on putting her name on all of the
00:15:41
filings and she refuses to walk out of
00:15:43
the office where she doesn't belong like
00:15:46
the streaker in that example and she's
00:15:48
ruining the game. But in this case,
00:15:50
we're not dealing with a baseball game
00:15:52
where the stakes are who's going to win
00:15:53
the Dodgers or Toronto Blue Jays, which
00:15:56
I know still have a lot of impact on
00:15:58
people's lives. But the issue here is,

is a drug trafficker going to be
00:16:02
convicted? although Trump will probably
00:16:03
pardon that trafficker anyway. Or what's
00:16:05
going to happen on this espionage case?

And what's going to happen on this fraud
00:16:09
case? Or what's going to happen on this
00:16:11
Ponzi scheme case or sex trafficking
00:16:13
case? And the Department of Justice is
00:16:16
out there having basically a streaker
00:16:19
put their name attached to these things
00:16:20
where they don't belong. And the courts
00:16:22
are like, "Why are you doing stop it?
00:16:24
Just get just take her name off the
00:16:26
freaking document and tell her to go out
00:16:27
of the office so we can actually handle
00:16:29
business here and be like adults." And

you've got Bondi and Todd Blanch like

and people like dude why are you be and

the judges like are like why are you
00:16:39
behaving like this and how is this the
00:16:41
DOJ like how that's what's happening

here. I'll give you the last word.

political win the law be down. But two

other points, there's a way to make

Lindseay Halligan, the uh US attorney

for the Eastern District of Virginia,

Trump can nominate her and the Senate

with its 53 Republicans can confirm her.

But no way that's happening here because
00:17:10
it's quite clear we have an incompetent,
00:17:12
inexperienced person who should never be
00:17:15
within a mile of the US attorney's
00:17:17
office, much less in the US attorney's
00:17:20
chair. And then second, here's what
00:17:22
they've done with Alina Haba. They've um
00:17:25
understood that they're totally
00:17:28
um interfering with public safety, as
00:17:31
you say. They've set her aside. They're
00:17:32
giving her some bogus uh you know,
00:17:36
landing pad kind of title. And but
00:17:39
they'll continue to fight it is what
00:17:40
they said. And if the Supreme Court uh
00:17:43
holds that the third circuit was
00:17:45
mistaken and Haba really should be or
00:17:48
it's her her her appointment is
00:17:50
unproatic, she'll come back and be put
00:17:53
in in in this temporary
00:17:56
way if they if the Supreme Court green
00:17:58
lights it the way they tried to do it
00:18:00
while still bypassing uh congressional
00:18:03
review. They could do the same with
00:18:06
Hallagan. what they're insisting on
00:18:08
doing. And I think because it's become
00:18:12
even more politically contentious than
00:18:14
Haba, and it should be because she's the
00:18:17
one who's come in not only with zero
00:18:19
zero uh nothing from nothing leaves zero
00:18:23
experience, but to um get the scalps of
00:18:27
political enemies. and she did it. I
00:18:29
think it would appear we we may not ever
00:18:31
find out in very improper ways. But they
00:18:35
they could uh now just tack toward the
00:18:39
law as it's really clearly emerging. But
00:18:43
instead, I think as you say, ner boo,
00:18:47
we're going to continue to call her the
00:18:49
US attorney. I think sort of Trump wants
00:18:52
it. Law bean, public safety be dan. poor
00:18:56
hap, you know, prosecutors in the
00:18:58
Eastern District of Virginia be damned.

We don't care because Trump likes this

former insurance lawyers come beauty

contestant. And uh screw the public
00:19:09
safety. There's really no other way to

rationalize this whole uh misadventure.

had political views and that may have

pushed me to do some types of law over

other types of law and feel certain ways

about some cases versus others, but at

the end of the day, when it came to what

the Constitution said and and who
00:20:04
controlled the the rules of the game,
00:20:06
that was never really in dispute. And
00:20:08
under the Trump regime, they're just
00:20:10
taking a whack-a-mole to it. And they
00:20:12
are destroying something that actually
00:20:15
was the envy of the world a little bit.

That was something our lawyers and
00:20:20
judges would travel the world to show
00:20:21
how our system worked and now our system
00:20:24
looks like, you know, Russia basically.
