00:00:00
This is Democracy Watch. Mark, we have
00:00:02
some breaking news here to kind of add
00:00:04
add fuel to the fire that is already
00:00:05
this disastrous Epstein file release. It
00:00:08
looks like the DOJ has rescended, pulled
00:00:10
back, deleted 16 files off their website
00:00:13
that had been there yesterday. And
00:00:15
again, I want to add that this was
00:00:17
already in on top of the fact that the
00:00:19
DOJ had not released all of the files in
00:00:21
compliance with the law. So what are the
00:00:23
legal implications here of the fact that
00:00:25
A we didn't get the full breadth of
00:00:27
files and B even some of the files that
00:00:29
were released were then taken back
00:00:31
presumably to protect Donald Trump.
00:00:33
>> Okay, so let's talk about all the ways
00:00:35
in which the Trump Department of Justice
00:00:37
is violating federal law. And that's
00:00:38
what they're doing everyone. They are
00:00:40
violating federal law. A law that
00:00:42
Congress passed signed by Donald Trump
00:00:44
that said number one the records have to
00:00:46
be released within 30 days. All of them.
00:00:48
Did we get all of the records on Friday?
00:00:51
No. So that was violation of law number
00:00:53
one. Number two, it said that it has to
00:00:56
include all unclassified records,
00:00:58
documents, communications, and
00:00:59
investigative materials. Have you seen
00:01:00
any investigative materials? Have you
00:01:02
seen any memos between the FBI and
00:01:04
prosecutors or between FBI agents and
00:01:06
each other? No. That would be violation
00:01:08
number two. Number three, uh it can only
00:01:11
redact names under limited
00:01:12
circumstances. For example, to protect
00:01:14
victims. We saw, Brian, pages, pages,
00:01:17
dozens of pages upon dozens of pages in
00:01:19
a row of redactions. Not just names of
00:01:22
victims, but all kinds of things. And
00:01:23
you whose name we didn't see? We didn't
00:01:25
see Donald Trump's. That's another
00:01:27
violation. Also, the statute said that
00:01:29
the records that any red actions have to
00:01:31
be accompanied, quote, by a written
00:01:33
justification. Now, I know they're not
00:01:35
big on like writing over there in the
00:01:38
Department of Justice, but I didn't see
00:01:40
any written explanation of each of these
00:01:42
redactions. And then the most important
00:01:44
one is that no record could be withheld,
00:01:46
delayed or redacted on the base of
00:01:49
embarrassment, reputational harm or
00:01:51
political sensitivity, including to any
00:01:53
government official, public figure or
00:01:54
foreign dignitary. This Brian has turned
00:01:57
into a total sham. This whole thing has
00:02:00
been an effort to protect Donald Trump.
00:02:02
They obviously didn't produce records
00:02:04
and they redacted name uh his name from
00:02:07
records are on. How do we know that?
00:02:09
Because we have other sources of these
00:02:11
records. We have gotten records from uh
00:02:13
the h the house uh uh committee itself
00:02:16
that it got from the estate that has
00:02:17
Donald Trump's name. And so we know
00:02:19
those haven't been produced. But then
00:02:20
the cherry on top, the final violation
00:02:23
of this law that Congress just passed
00:02:26
that the president signed that
00:02:27
Republicans piously lined up and said
00:02:29
they wanted the truth to come out on the
00:02:31
cherry on top is that the Trump Justice
00:02:33
Department has apparently now
00:02:35
unpublished has pulled back from the
00:02:37
public. uh according to the Associated
00:02:39
Press 16 files and at least some of them
00:02:42
it's pretty clear were pulled back
00:02:44
because somehow the the you know the
00:02:47
North Korean sensors that they had
00:02:49
reviewing these records in the
00:02:51
Department of Justice missed some photos
00:02:53
of Donald Trump.
00:02:54
>> So I I have to ask because there was one
00:02:57
one thing in particular that that really
00:02:59
kind of insensed me and that was this
00:03:01
idea that in the law itself it says that
00:03:04
the only people that have to have their
00:03:05
identities protected are victims or
00:03:06
minors. There was it was written
00:03:08
expressly that that items could not be
00:03:11
redacted simply because they would cause
00:03:13
embarrassment to for example political
00:03:15
figures. And then when the DOJ spoke
00:03:18
with Fox News, they said that items were
00:03:21
redacted expressly because people were
00:03:23
either politically uh engaged or or
00:03:26
government officials. And so this is in
00:03:28
direct violation of of the letter of the
00:03:30
law. How could they not only refuse to
00:03:32
abide by the full law which stated that
00:03:35
all of the files had to be released but
00:03:37
then completely twist upside down what
00:03:39
the law actually says and basically
00:03:42
where it says you can't do something
00:03:44
they expressly said that they will.
00:03:46
>> Yeah. They're just breaking the law. I
00:03:48
mean I just listed five ways in which
00:03:50
the Trump Department of Justice is
00:03:52
breaking the law. So you've picked one
00:03:53
of those five and it's probably the most
00:03:55
serious of those five. And let's be
00:03:57
clear, what Fox uh News reported or Fox
00:04:00
News digital uh reported was that the
00:04:02
redactions were applied to quote
00:04:04
politically exposed individuals and
00:04:06
government officials.
00:04:08
>> What the is a politically exposed
00:04:10
individual? I mean, someone who has been
00:04:12
exposed because they, for example, were
00:04:15
close to Jeffrey Epstein,
00:04:16
>> right? Which which is the whole point of
00:04:17
the release of the Epstein files.
00:04:19
>> Correct. It's the whole point that the
00:04:20
files are being released. And so they
00:04:23
are not just twisting it. They're not
00:04:24
just like turning on its head. They are
00:04:27
breaking it. They are knowingly and
00:04:29
willfully violating a federal law that
00:04:31
was passed specifically for this purpose
00:04:34
just 30 some odd days ago by an
00:04:37
overwhelmingly bipartisan uh vote in
00:04:40
which all the Republicans in Congress
00:04:42
lined up and said, "Oh, look at us. We
00:04:45
stand for the release of the full
00:04:47
Epstein files. Donald Trump signed that
00:04:49
and now they're breaking it." And so
00:04:51
here are the two questions, Brian, that
00:04:53
everybody out there needs to be paying
00:04:54
attention to. Number one, will there be
00:04:57
any accountability within the
00:04:59
government? And of course, the answer to
00:05:00
that is no because Pam Bondi is a
00:05:02
sickopan for Donald Trump and Pam
00:05:04
Bondi's Department of Justice is not
00:05:05
going to look at itself. You know, no
00:05:07
one's going to look at whether the White
00:05:08
House played a role here. So, that
00:05:09
brings us to the second thing, which is
00:05:11
where the hell is the corporate legacy
00:05:12
media? You know, these people who who
00:05:15
say that the what what makes them better
00:05:19
enough said what they say makes them
00:05:21
better than the rest of us. The thing
00:05:23
that they say they can do that nobody
00:05:25
else can do is deep investigative
00:05:27
reporting about public corruption by the
00:05:30
highest echelons in government and
00:05:32
coverups. Right? The Washington Post,
00:05:34
right? Democracy dies in darkness. These
00:05:36
are the Woodward and Bernstein, you
00:05:38
know, legacy uh, you know, uh,
00:05:40
journalists who are feriting out all of
00:05:43
the cover-ups in the highest echelons of
00:05:45
government. Where the hell are they?
00:05:47
Where are they? We're we're we're
00:05:48
already, you know, more than 24 hours
00:05:50
into this uh coming on on on two days
00:05:53
into this where they didn't release all
00:05:55
the files and where it was plain from
00:05:57
the moment the first file was rem
00:05:59
released that there were redactions that
00:06:01
violated that. Now look, credit to the
00:06:03
Associated Press and you know, my my
00:06:06
team at Democracy Docket published uh
00:06:08
the fact that that that these records
00:06:10
have been pulled back. So kudos to the
00:06:11
Associated Press that figured out I was
00:06:13
16 of them. But you know, where where is
00:06:16
the rest? Where is the outrage? Why is
00:06:18
this not leading the news on every major
00:06:21
broadcast and and the front page of
00:06:23
every newspaper?
00:06:24
>> I want to use this opportunity, by the
00:06:26
way, to highlight the fact that you have
00:06:28
been covering this even in the absence
00:06:30
of legacy media doing its job. So,
00:06:32
highly recommend for anybody who's
00:06:33
watching right now, if you want to stay
00:06:34
uptodate on what's happening, please
00:06:36
subscribe to Democracy Docket. That's
00:06:37
the news outlet Mark founded to focus on
00:06:39
everything voting and elections and
00:06:40
what's happening right now. So, I'm
00:06:42
going to put that link right here on the
00:06:43
screen and also in the post description
00:06:45
of this video. If you believe that Mark
00:06:46
and his team's voices should be
00:06:48
elevated, this is the best way to do it.
00:06:50
Mark, it's worth asking here in terms of
00:06:52
a remedy because, you know, we
00:06:55
recognize, we understand that the Trump
00:06:57
administration and the DOJ are going to
00:06:59
violate the law every chance they get.
00:07:00
And so, in terms of seeking some remedy
00:07:02
here, how do you achieve the full
00:07:04
release of the Epstein files? How do you
00:07:06
get some accountability when the people
00:07:08
who have all of the ability to enforce
00:07:10
the laws are the ones who are themselves
00:07:12
violating it?
00:07:13
>> Right? So, this is of course the great
00:07:14
dilemma that we face right now, which is
00:07:16
that you have a White House that is
00:07:18
corrupt, that is controlling a
00:07:19
Department of Justice that are just
00:07:21
their puppets. Yeah. And so, we can't
00:07:22
look there. You know, I skipped over and
00:07:25
it it shows you how how just awful and
00:07:29
terrible Mike Johnson and the House
00:07:30
Republicans are and John Thoon and the
00:07:32
Senate Republicans are that I didn't
00:07:33
even mention the possibility that they
00:07:35
might grow a spine,
00:07:37
>> right? Because they because they just
00:07:38
won't. It's it's that clear,
00:07:40
>> right? Because like the easiest thing
00:07:41
would be for the House and the Senate
00:07:42
leadership to sue the Trump
00:07:45
administration, say, "Hey, we're
00:07:46
Congress. We're entitled to these
00:07:48
records or issue subpoenas and hold
00:07:50
people in contempt, you know, tell Pam
00:07:52
Bondi she's to appear in the House or in
00:07:54
the Senate uh for a deposition next
00:07:56
week, you know, before Christmas." Like,
00:07:58
you could imagine that that happening,
00:08:00
but that isn't going to happen, right?
00:08:01
That so that's off the table. DOJ is not
00:08:03
going to do it. So, it's ultimately up
00:08:05
to us, right? It's up to you and me and
00:08:08
other pro-democracy independent news
00:08:09
outlets. It's up to those in the legacy
00:08:11
media that have the spine in the
00:08:13
backbone backbone like the Associated
00:08:15
Press to call this out. And ultimately,
00:08:18
it's up to the viewers like people like
00:08:20
you who are watching this video to to to
00:08:23
use this to catalyze a pro-democracy
00:08:27
movement for 2026. You know, we're on
00:08:29
the eve of an election year, and the way
00:08:31
in which this will change is through the
00:08:33
ballot box. And yes, there are going to
00:08:35
be a lot of obstacles. There's going to
00:08:36
be a lot of misinformation. There's
00:08:38
going to be a lot of efforts by
00:08:39
Republicans to suppress the vote. Uh
00:08:41
probably uh engage in uh uh election
00:08:43
subversion, but ultimately, we need you
00:08:46
to be out there telling people about
00:08:48
what is going on because the Legacy
00:08:50
Media is not doing its job. We need you
00:08:52
to support people like Brian Tyler Conn
00:08:54
by by subscribing to this channel and
00:08:56
hitting the bell to make sure you are
00:08:57
kept informed when when he and I post
00:08:59
new videos and and others post and he
00:09:02
posts other new videos on his on his
00:09:03
channel. And it's up to you to make sure
00:09:06
you are registered to vote, your friends
00:09:07
and families are registered to vote and
00:09:10
that everybody keep their eye on the
00:09:12
ball this uh you know next November.
00:09:14
>> And I'll I'll just note for those who
00:09:16
are not yet subscribed to this channel,
00:09:17
I'm going to put a link right here on
00:09:18
the screen so you can go ahead and
00:09:19
subscribe. Mark, I have to ask kind of a
00:09:22
political question here. Doesn't the
00:09:24
Trump administration recognize that that
00:09:26
by virtue of prolonging this cover up,
00:09:28
all they're doing is is increasing the
00:09:30
pain for themselves? Like, we can all
00:09:32
see what's happening. We can all see
00:09:34
when they release, you know, a fraction
00:09:36
of the Epstein files already bad enough,
00:09:38
but then the files that they do release
00:09:40
heavily redacted and just page after
00:09:43
page, there were grand jury transcripts
00:09:44
where the whole thing, 100% of them were
00:09:46
redacted. Don't they recognize that
00:09:48
they're just adding to this narrative
00:09:50
that they are already participating in a
00:09:52
coverup?
00:09:53
>> Yes, they are. And so you have to ask
00:09:56
why. >> Right?
00:09:57
>> So there are, I think, [clears throat]
00:09:59
two reasons, both of which are true. The
00:10:02
first is they have decided that this is
00:10:04
an instance where the cover up is not
00:10:05
worse than the crime. Right? Everyone
00:10:07
always says that the cover up is always
00:10:08
worse than crime. No, no, that's
00:10:10
actually not true. Like sometimes the
00:10:12
crime's really bad and so the cover up
00:10:14
is actually better than acknowledging
00:10:16
what's underneath. As crappy as the
00:10:19
cover up looks, like you're actually
00:10:20
better off. So you should judge
00:10:23
>> and you know you should consider why
00:10:27
they are going to all this effort as you
00:10:30
either decide to give them the benefit
00:10:31
of the doubt or not give them the
00:10:32
benefit of the doubt. So that that's
00:10:33
number one. And then the second is they
00:10:35
think they can get away with it because
00:10:37
they have a compliant media. Like, you
00:10:39
know, if this was the days of Watergate,
00:10:42
you know, they wouldn't think they could
00:10:43
get away with it because the only
00:10:45
questions the legacy media would ask
00:10:47
them every day over and over again were
00:10:48
about the Epstein files. They wouldn't
00:10:50
let them move on. They wouldn't cover a
00:10:52
address from the White House
00:10:54
like like all these outlets just did. By
00:10:57
the way, Brian, you know, I don't know
00:10:58
that you and I have have had a chance to
00:11:00
talk about this very much, but you know,
00:11:02
when Barack Obama wanted to give an
00:11:04
address uh in 2009 uh press conference
00:11:08
uh in prime time, Fox News said no. In
00:11:10
2014, when he wanted to do a prime time
00:11:12
address, all the networks said no. And
00:11:14
Donald Trump wants to give this
00:11:16
thing like he's, you know, on some kind
00:11:18
of whatever, you know, stimulant and
00:11:20
he's rushing through everything and he's
00:11:22
yelling and none, it's like none of it
00:11:23
makes any sense that they cover. But the
00:11:25
White House knows that that media, the
00:11:28
media that put that that that that crap
00:11:31
on prime time is not gonna hold them
00:11:33
accountable here.
00:11:34
>> Right. I I think that that's perfectly
00:11:36
put and again it underscores the need
00:11:38
for fearless independent journalism and
00:11:40
that's exactly what you'll get with
00:11:41
Democracy. So, one more time, I'm going
00:11:43
to put the link to Democracy Docket
00:11:44
right here on the screen and also in the
00:11:45
post description of this video. if you
00:11:47
recognize the issues that we're
00:11:48
contending with in this media ecosystem,
00:11:50
which if it's not owned by some Trump
00:11:53
acolyte, uh they're perfectly content to
00:11:55
be compliant uh alongside the media
00:11:58
outlets that are owned by Trump
00:11:59
acolytes. So, um this is, you know, as
00:12:02
big a signal as you can possibly get
00:12:04
that we need to support independent
00:12:05
media that's actually going to hold uh
00:12:07
truth to power here. And that's exactly
00:12:08
what you'll get with Democracy Docket.
00:12:09
So, I'm going to put that link right
00:12:11
here on the screen and also in the post
00:12:12
description. And of course, if you want
00:12:13
to subscribe to this channel, that link
00:12:14
is on the screen as well. I'm Brian
00:12:16
Taylor Cohen.
00:12:17
>> I'm Mark Elias.
00:12:18
