uh these uh documents are not entitled

to any constitutional protection

and one of the reasons given in that

supreme court judgment one of the

reasons given for that is that if

foreign Nationals acting abroad were

entitled to constitutional protections

then the United States military would

have to Grant constitutional rights to
01:36:11
enemy combatant with whom they were in
01:36:13
contact meaning of course uh that the
01:36:16
people in grantan oey for example would
01:36:18
have constitutional rights so that there
01:36:22
are complex reasons why the Americans
01:36:25
are going to be both unable and
01:36:28
unwilling uh to give an assurance uh on
01:36:31
the
01:36:32
grounds of no discrimination against him
01:36:35
on the grounds of nationality on the
01:36:37
grounds that he would be allowed to
01:36:38
plead the First Amendment because it's
01:36:40
not by any means plain that he would be
01:36:42
allowed to to plead the First

Amendment and the US government is not

in a position to give that Assurance uh

even if they were it uh I'm on the same

page as you I think that's by far the
