rely on the First Amendment as a foreign01:35:13
National because that's up to the judge01:35:16
and nobody can assure what what a judge01:35:19
is going to to decide um and as Julian's01:35:24
um defense case put forward in his uh01:35:29
application for an appeal and as the01:35:32
Judgment refers to that there is a01:35:34
supreme court judgment which states that01:35:38
foreign Nationals acting abroad and01:35:41
Julian of course was foreign National01:35:44
acting abroad at the time he published01:35:48
uh these uh documents are not entitled01:35:51
to any constitutional protection01:35:55
and one of the reasons given in that01:35:56
supreme court judgment one of the01:35:59
reasons given for that is that if01:36:01
foreign Nationals acting abroad were01:36:04
entitled to constitutional protections01:36:07
then the United States military would01:36:09
have to Grant constitutional rights to01:36:11
enemy combatant with whom they were in01:36:13
contact meaning of course uh that the01:36:16
people in grantan oey for example would01:36:18
have constitutional rights so that there01:36:22
are complex reasons why the Americans01:36:25
are going to be both unable and01:36:28
unwilling uh to give an assurance uh on01:36:31
the01:36:32
grounds of no discrimination against him01:36:35
on the grounds of nationality on the01:36:37
grounds that he would be allowed to01:36:38
plead the First Amendment because it's01:36:40
not by any means plain that he would be01:36:42
allowed to to plead the First01:36:46
Amendment and the US government is not01:36:49
in a position to give that Assurance uh01:36:52
even if they were it uh I'm on the same01:36:55
page as you I think that's by far the01:36:57
most honorous of the three uh conditions01:37:01
that the British judges have sent to01:37:05
Washington uh and could actually Scupper01:37:08
the trial couldn't it if they refused to01:37:11
give those assurances or at least that01:37:13
one Assurance the judges yesterday said01:37:18
that Julian would have high chance of01:37:21
success in an appeal uh and therefore we01:37:27
